Can I delete old company emails?
Short answer
Often yes, but not blindly. Email that counts as a required business record (tax, payroll, employment, contracts, industry records) has to be kept for its retention period, and anything relevant to a dispute must be preserved. The rest can go, though a firm's email archive is also one of the records AI developers most want to license.
Email is kept by what it says, not by being email
There's no single rule like "keep email for X years". An email that is an invoice, a contract, a payroll record, a safety report or an industry-required record falls under that record's own retention period. See How long to keep business records.
Before you delete
- Check for disputes. If a lawsuit, claim, audit or investigation is pending or reasonably expected, preserve relevant email. That duty overrides your normal schedule.
- Pull out required records. Contracts, invoices, payroll and HR correspondence, safety and industry records, if they only exist in email.
- Check your own promises. Client contracts and your privacy notice may say how long you keep, or must delete, certain information.
- Then delete the rest consistently, following a written policy, not case by case.
Why your email archive may be worth something
An email archive is a firm's decisions in writing: the quote negotiation, the supplier problem, the change to the job. AI developers value that more than almost any other kind of business record, because it shows real professional work.
It's also the part that's heaviest with personal and client information. So it's rarely licensed as is. Usually a cleaned subset is licensed, or it's left out. See What about client confidentiality and personal data?
A sensible order
Keep what you must, destroy what holds personal data you no longer need, and before deleting the rest, ask whether the archive is worth licensing.
Quick questions
Is there one retention period for business email?
No. Email is kept according to what it contains. An email that is a contract, an invoice or a payroll record falls under that record's retention period.
What if there's a lawsuit or dispute?
Once litigation is pending or reasonably expected, you must preserve relevant email and documents, even if your normal schedule would delete them. Talk to your lawyer.
Why would anyone want old company email?
Because it shows how work really gets done: questions, decisions, negotiations. That's why AI developers license email archives, after personal information is removed.
